ਭਾਰਤ ‘ਚ ਸੰਘਰਸ਼ਸ਼ੀਲ ਧਿਰਾਂ ਨੂੰ ਕੁਚਲਣ ਦੀ ਇਕ ਹੋਰ ਸਾਜਿਸ਼

2001 ਵਿਚ ਅਮਰੀਕਾ ‘ਚ ਵਾਪਰੀ 9/11 ਦੀ ਦਹਿਸ਼ਤੀ ਘਟਨਾ ਨੇ ‘ਅੱਤਵਾਦ’ ਨੂੰ ਇਕ ਸੰਸਾਰ-ਵਿਆਪੀ ਵਰਤਾਰੇ ਵਜੋਂ ਮਾਨਤਾ ਦਿੱਤੀ ਹੈ, ਕਿਉਂਕਿ ਇਸ ਨੇ ਉਸ ਦੇਸ਼ ਦੀ ਸੁਰੱਖਿਆ ਨੂੰ ਤਕੜੀ ਸੱਟ ਮਾਰੀ ਜੋ ਦੁਨੀਆ ‘ਚ ਸਭ ਤੋਂ ਤਾਕਤਵਰ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ। ਇਸ ਘਟਨਾ ਦਾ ਸੇਕ ਲੱਗਣ ਤੱਕ ਅਮਰੀਕਾ ਨਾ ਸਿਰਫ਼ ਅਜਿਹੀ ਸਰਗਰਮੀ ਨੂੰ ਹਲਕੇ ਢੰਗ ਨਾਲ ਲੈਂਦਾ ਰਿਹਾ ਹੈ, ਸਗੋਂ ਸੰਸਾਰ ਦੇ ਕਈ ਹਿੱਸਿਆਂ ‘ਚ ਇਸ ਨੂੰ ਉਤਸ਼ਾਹਿਤ ਵੀ ਕਰਦਾ ਰਿਹਾ ਹੈ। ‘ਤਾਲਿਬਾਨ’ ਨਾਂਅ ਦੀ ਖਾੜਕੂ ਜੱਥੇਬੰਦੀ ਅਮਰੀਕਾ ਦੀ ਹੀ ਉਪਜ ਮੰਨੀ ਜਾਂਦੀ ਹੈ। ਉਕਤ ਘਟਨਾ ਨੇ ਅਮਰੀਕਾ ਨੂੰ ਦਹਿਸ਼ਤੀ ਸਰਗਰਮੀ ਦੀ ਰੋਕਥਾਮ ਲਈ ਵੱਡੇ ਪੱਧਰ ‘ਤੇ ਕਦਮ ਚੁੱਕਣ ਲਈ ਮਜਬੂਰ ਕੀਤਾ ਤੇ ਇਸੇ ਵਿਚੋਂ ਹੀ ‘ਕੌਮੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਦੇ ਗਠਨ ਦਾ ਵਿਚਾਰ ਪੈਦਾ ਹੋਇਆ। ਭਾਰਤ ਵੱਲੋਂ ਹਾਲ ਹੀ ‘ਚ ‘ਰਾਸ਼ਟਰੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਦੇ ਗਠਨ ਦੀ ਸ਼ੁਰੂ ਕੀਤੀ ਗਈ ਸਰਗਰਮੀ ਵੱਡੀ ਹੱਦ ਤੱਕ ਅਮਰੀਕਾ ਦੇ ਉਕਤ ਵਿਚਾਰ ਨੂੰ ਅਪਨਾਉਣ ਦਾ ਹੀ ਅਮਲ ਹੈ। ਇਸ ਤੋਂ ਪਹਿਲਾਂ ਵੀ ਵਾਜਪਾਈ ਸਰਕਾਰ ਵੇਲੇ ਭਾਰਤ ਨੇ ‘ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’, ਜੋ ਕਿ ਛੋਟੇ ਪੱਧਰ ‘ਤੇ ਕਾਰਜਸ਼ੀਲ ਸੀ, ਦੇ ਰੂਪ ਵਿਚ ਅਮਰੀਕੀ ਮਾਡਲ ਦੀ ਨਕਲ ਕੀਤੀ ਸੀ। ‘ਅੱਤਵਾਦ ਵਿਰੋਧੀ ਕੇਂਦਰ’ ਅਮਰੀਕਾ ਵਿਚ 9/11 ਦੀ ਘਟਨਾ ਤੋਂ ਪਹਿਲਾਂ ਘਰੇਲੂ ਪੱਧਰ ‘ਤੇ ਕੁਝ ਸਾਲਾਂ ਲਈ ਕਾਰਜਸ਼ੀਲ ਰਿਹਾ ਹੈ। ਜਿਸ ਤਰ੍ਹਾਂ 9/11 ਦੀ ਘਟਨਾ ਨੇ ਅਮਰੀਕਾ ਨੂੰ ਵੱਡਾ ਸਦਮਾ ਪਹੁੰਚਾਇਆ, ਉਸੇ ਤਰ੍ਹਾਂ ਭਾਰਤ ਨੂੰ 2008 ਦੀ 26/11 ਦਹਿਸ਼ਤੀ ਘਟਨਾ ਨੇ ਵੱਡੀ ਪੱਧਰ ‘ਤੇ ਪ੍ਰਭਾਵਿਤ ਕੀਤਾ, ਚਾਹੇ ਭਾਰਤ ‘ਚ ਦਹਿਸ਼ਤੀ ਸਰਗਰਮੀਆਂ ਇਸ ਦੇ ਕਈ ਇਲਾਕਿਆਂ ‘ਚ ਕਈ ਦਹਾਕਿਆਂ ਤੋਂ ਚਲਦੀਆਂ ਆ ਰਹੀਆਂ ਹਨ। 26/11 ਦੀ ਘਟਨਾ ਵਾਪਰਨ ਤੱਕ ਭਾਰਤ ‘ਚ ਅਮਰੀਕਾ ਦੇ ਇਸ ਪੁਰਾਣੇ ‘ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਦੀ ਤਰਜ਼ ‘ਤੇ ਹੀ ਇਕ ਕੇਂਦਰ ਜਿਸ ਨੂੰ ‘ਮਲਟੀ ਏਜੰਸੀ ਸੈਂਟਰ’ ਵਜੋਂ ਵੀ ਜਾਣਿਆ ਜਾਂਦਾ ਸੀ, ਕੰਮ ਕਰਦਾ ਆਇਆ ਹੈ ਤੇ ਉਹ ਵੀ ਭਾਰਤੀ ਖ਼ੁਫੀਆ ਏਜੰਸੀ ‘ਇੰਟੈਲੀਜੈਂਸ ਬਿਊਰੋ’ (ਆਈ ਬੀ) ਦੇ ਅਧੀਨ ਸੀ। ਪਰ 26/11 ਤੋਂ ਬਾਅਦ ਭਾਰਤ ਦੇ ਹੁਕਮਰਾਨਾਂ ਨੂੰ ਅਮਰੀਕਾ ਦੇ ਮੌਜੂਦਾ ‘ਕੌਮੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਦੀ ਨਕਲ ਕਰਨ ਦੀ ਲੋੜ ਮਹਿਸੂਸ ਹੋਈ ਕਿਉਂਕਿ ਉਹ ਭਾਰਤ ਦੇ ਮੌਜੂਦਾ ਖੁਫੀਆ ਤਾਣੇ-ਬਾਣੇ ਤੋਂ ਅਸੰਤੁਸ਼ਟ ਸਨ। ਭਾਰਤ ਦੇ ਗ੍ਰਹਿ ਮੰਤਰੀ ਪੀæ ਚਿਦੰਬਰਮ ਨੇ ਅਮਰੀਕਾ ਦੇ ਦੌਰੇ ਤੋਂ ਬਾਅਦ ਅਜਿਹਾ ਕੇਂਦਰ ਗਠਤ ਕਰਨ ਦਾ ਫੈਸਲਾ ਕੀਤਾ। ਪਰ ਭਾਰਤ ਦਾ ‘ਕੌਮੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਅਮਰੀਕਾ ਦੇ ਕੇਂਦਰ ਨਾਲੋਂ ਦੋ ਪੱਖਾਂ ਤੋਂ ਵੱਖਰਾ ਹੈ। ਅਮਰੀਕਾ ਵਾਲਾ ਕੇਂਦਰ ਇਕ ਆਜ਼ਾਦ ਸੰਸਥਾ ਹੈ ਤੇ ਕਿਸੇ ਪਹਿਲਾਂ ਤੋਂ ਮੌਜੂਦ ਸੰਸਥਾ ਦੇ ਅਧੀਨ ਨਹੀਂ ਹੈ। ਭਾਰਤ ਵਿਚ ਇਸ ਨੂੰ ਆਈ ਬੀ ਦੇ ਅਧੀਨ ਰੱਖਿਆ ਗਿਆ ਹੈ ਤੇ ਇਹ ਆਈ ਬੀ ਦੇ ਡਾਇਰੈਕਟਰ ਅਧੀਨ ਰਹਿ ਕੇ ਕੰਮ ਕਰੇਗਾ।
ਦੂਜਾ, ਅਮਰੀਕਾ ਵਿਚਲਾ ਕੇਂਦਰ ਇਕ ਕਾਨੂੰਨੀ ਸੰਸਥਾ ਹੈ, ਜਿਸ ਨੂੰ ਵੱਡੇ ਵਿਚਾਰ-ਵਟਾਂਦਰੇ ਤੋਂ ਬਾਅਦ ਵਿਧਾਨਕਾਰਾਂ ਦੀ ਸਹਿਮਤੀ ਨਾਲ ਇਕ ਕਨੂੰਨ ਬਣਾ ਕੇ ਗਠਿਤ ਕੀਤਾ ਗਿਆ। ਪਰ ਇਸ ਨੂੰ ਆਜ਼ਾਦਾਨਾ ਰੂਪ ‘ਚ ਕਿਸੇ ਕਥਿਤ ਦੋਸ਼ੀ ਨੂੰ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰਨ, ਨਜ਼ਰਬੰਦ ਕਰਨ, ਬੰਦੀ ਬਣਾ ਕੇ ਉਸ ਦੀ ਪੁੱਛ-ਗਿੱਛ ਕਰਨ ਆਦਿ ਦੀਆਂ ਕਾਨੂੰਨੀ ਤਾਕਤਾਂ ਨਹੀਂ ਹਨ।
ਭਾਰਤ ਦਾ ‘ਰਾਸ਼ਟਰੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਸਰਗਰਮੀਆਂ ਰੋਕੂ ਕਾਨੂੰਨ 1967 ਤਹਿਤ ਸੱਤਾਧਾਰੀ ਧਿਰ ਵੱਲੋਂ ਇਕ ਨੋਟੀਫਿਕੇਸ਼ਨ ਜਾਰੀ ਕਰਕੇ ਗਠਿਤ ਕੀਤਾ ਜਾ ਰਿਹਾ ਹੈ। ਅਜਿਹੇ ਅਮਲ ਨੂੰ ਸਿਰੇ ਚੜ੍ਹਾਉਣ ਲਈ ਸੰਸਦ ਦੀ ਮਨਜ਼ੂਰੀ ਲੈਣ ਤੇ ਰਾਜਾਂ ਦੀ ਸਲਾਹ ਲੈਣ ਦੀ ਕੋਈ ਲੋੜ ਨਹੀਂ ਸਮਝੀ ਗਈ। ਵਧੇਰੇ ਗੰਭੀਰਤਾ ਵਾਲੀ ਗੱਲ ਇਹ ਹੈ ਕਿ ਭਾਰਤ ਦੇ ਇਸ ਕੇਂਦਰ ਨੂੰ ਅੱਤਵਾਦ ਰੋਕੂ ਕਦਮਾਂ ਤਹਿਤ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰਨ ਅਤੇ ਦੋਸ਼ੀਆਂ ਦੀ ਭਾਲ ਕਰਨ ਦੀਆਂ ਤਾਕਤਾਂ ਵੀ ਦਿੱਤੀਆਂ ਜਾ ਰਹੀਆਂ ਹਨ।
ਇਸ ‘ਕੌਮੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਦੇ ਬੀਤੀ 5 ਫਰਵਰੀ ਨੂੰ ਭਾਰਤ ਦੇ ਕੇਂਦਰੀ ਗ੍ਰਹਿ ਮੰਤਰੀ ਵੱਲੋਂ ਜਾਰੀ ਕੀਤੇ ਗਏ ਨੋਟੀਫਿਕੇਸ਼ਨ ਵਿਚ ਇਸ ਕੇਂਦਰ ਦੇ ਡਾਇਰੈਕਟਰ ਨੂੰ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਸਰਗਰਮੀਆਂ (ਰੋਕੂ) ਕਾਨੂੰਨ 1967 ਦੀ ਧਾਰਾ ਐਸ-2(ਈ) ਅਧੀਨ ‘ਡੈਜ਼ੀਨੇਟਿਡ ਅਥਾਰਟੀ’ ਵਜੋਂ ਨਿਯੁਕਤ ਕੀਤਾ ਗਿਆ ਹੈ। ਇਸ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ ਐਸ 43-ਏ ਅਧੀਨ ਇਸ ਦੇ ਡਾਇਰੈਕਟਰ ਨੂੰ (ਕਥਿਤ ਦੋਸ਼ੀ ਨੂੰ) ‘ਭਾਲਣ’ ਅਤੇ ‘ਗ੍ਰਿਫ਼ਤਾਰ ਕਰਨ’ ਦੀਆਂ ਤਾਕਤਾਂ ਮਿਲ ਜਾਂਦੀਆਂ ਹਨ। ਇਸ ਕੇਂਦਰ ਸਬੰਧੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਦੀ ਮਦ ਨੰਬਰ 3.1 ਕੇਂਦਰ ਨੂੰ ਸਾਰੇ ਕਥਿਤ ਅੱਤਵਾਦ ਰੋਕੂ ਅਮਲਾਂ ਨੂੰ ਆਪਣੇ ਅਧੀਨ ਕਰਨ ਦੀ ਤਾਕਤ ਦਿੰਦੀ ਹੈ। ਇਹ ਕੇਂਦਰ ਭਾਰਤ ਸਰਕਾਰ ਵੱਲੋਂ ਅਜਿਹੀ ਏਜੰਸੀ ਦੇ ਰੂਪ ਵਿਚ ਬਣਾਇਆ ਜਾ ਰਿਹਾ ਹੈ ਜੋ ਕਿ ਸੂਹ ਵੀ ਲਿਆ ਕਰੇਗੀ, ਛਾਣਬੀਣ ਵੀ ਕਰੇਗੀ ਅਤੇ ਕਾਰਵਾਈ ਵੀ ਕਰੇਗੀ। ਮਦ ਨੰਬਰ 3.5 ਵਿਚ ਇਸ ਨੂੰ ਅਜਿਹੀਆਂ ਸ਼ਕਤੀਆਂ ਦਿੱਤੀਆਂ ਗਈਆਂ ਹਨ ਜੋ ਇਸ ਦਾ ਰਾਜ ਸਰਕਾਰਾਂ ਉੱਤੇ ਗਲਬਾ ਕਾਇਮ ਕਰਦੀਆਂ ਹਨ। ਮਦ 5.1 ਅਨੁਸਾਰ ਪੁਲਿਸ ਮਹਿਕਮੇ ਸਣੇ ਰਾਜ ਸਰਕਾਰ ਦੇ ਵੱਖ-ਵੱਖ ਅਧਿਕਾਰੀ/ਮੁਲਾਜ਼ਮ ‘ਕੌਮੀ ਅੱਤਵਾਦ ਰੋਕੂ ਕੇਂਦਰ’ ਨੂੰ ਜਾਣਕਾਰੀ ਦੇਣ, ਦਸਤਾਵੇਜ਼ ਮੁਹੱਈਆ ਕਰਾਉਣ ਅਤੇ ਰਿਪੋਰਟ ਭੇਜਣ ਸਬੰਧੀ ਉਸ ਅੱਗੇ ਜਵਾਬਦੇਹ ਹਨ।
ਇਹ ਕੇਂਦਰ ਆਈ ਬੀ ਦੇ ਪ੍ਰਸ਼ਾਸਕੀ ਕੰਟਰੋਲ ਅਧੀਨ ਹੋਵੇਗਾ, ਜਿਸ ਦਾ ਮਤਲਬ ਇਹ ਹੋਵੇਗਾ ਕਿ ਇਸ ਕੇਂਦਰ ਦੇ ਜ਼ਰੀਏ ਆਈ ਬੀ ਨੂੰ ਪੁਲਿਸ ਸ਼ਕਤੀਆਂ ਮਿਲ ਜਾਣਗੀਆਂ ਜੋ ਇਸ ਗ਼ੈਰ-ਜਵਾਬਦੇਹ ਤੇ ਗੁਪਤ ਏਜੰਸੀ ਨੂੰ ਕਦੇ ਨਹੀਂ ਮਿਲੀਆਂ।
ਹੁਣ ਸਵਾਲ ਇਹ ਪੈਦਾ ਹੁੰਦਾ ਹੈ ਕਿ ਅਜਿਹੀ ਏਜੰਸੀ ਦਾ ਗਠਨ ਕਿੰਨਾ ਕੁ ਜਾਇਜ ਹੈ? ਜਾਂ ਇਹ ਭਾਰਤ ਵਿਚ ‘ਅੱਤਵਾਦ’ ਦੀ ਸਮੱਸਿਆ ਨੂੰ ਹੱਲ ਕਰਨ ‘ਚ ਕਿੰਨਾ ਕੁ ਕਾਮਯਾਬ ਹੋਵੇਗਾ?
